  • Civil Litigation
    • 2019 — Wayne County Common Pleas Court
      • Represented a beneficiary in a million dollar estate, contesting the Last Will and Trust upon grounds of undue influence and lack of testamentary capacity.  After presentation of three (3) days of witness, were able to reach a mutually agreeable settlement with other family members.
    • 2019 — Cuyahoga County Common Pleas Court
      • In commercial construction dispute, Eckinger Law client awarded judgment of over $31,000.00 by trial court on unjust enrichment claim after owner failed to pay on insulation work performed by contractor.
    • 2019 – Stark County Common Pleas Court
      • In dispute regarding multi-million dollar construction job, subcontractor filed suit against our client (general contractor) and sought judgment in excess of $200,000.00.  After a two day bench trial, court awarded judgment of just $3,100.00 to subcontractor.
    • 2018 – U.S. District Court for Middle District of Pennsylvania
      • Successfully obtained dismissal of construction client prior to trial in personal injury and products liability action brought by decedent’s estate in Federal Court.
    • 2018 – Canton Municipal Court
      • Obtained judgment of more than $10,000.00 against commercial tenant on behalf of landlord due to unpaid rent and damage to property beyond normal wear and tear.
    • 2018 – Stark County Common Pleas Court
      • Represented professional services company and collected on overdue account.
    • 2018 – Wayne County Probate Court
      • Obtained dismissal of client as party to declaratory judgment action filed by decedent’s children where client had been named trustee in decedent’s trust.
    • 2017 – Wayne County Common Pleas Court
      • Represented beneficiary of multi-million dollar estate in will contest action as well as a concealment action that included a two-day jury trial.
    • 2016 – Stark County Common Pleas Court
      • Successfully obtained summary judgment on behalf of business client in disability discrimination lawsuit filed by former employee seeking compensatory and punitive damages.
    • 2016 – Stark County Common Pleas Court
      • Represented seller/builder in fraudulent concealment action where buyer sought damages in excess of $180,000.00. Filed summary judgment on behalf of client, leading to dismissal of all claims by Plaintiff prior to trial.
    • 2013 – Portage County Common Pleas Court
      • Represented client in dispute over improper transfer of friend’s real property valued at over $170,000 into trust prior to his death where client was to beneficiary in decedent’s estate. Successfully obtained summary judgment finding that the deed transferring the property to the trust had been improperly notarized and, therefore, property must pass according to decedent’s will.

    • 2019 – Wayne County Probate Court
      • Obtained removal of executor and attorney for estate as well an order that the executor/attorney return a share of fees received due to failure to timely administer estate and obey court orders.
    • 2018 – Carroll County Probate Court
      • Obtained removal of executor for embezzlement of estate funds.
    • 2018 – Wayne County Probate Court
      • Obtained removal of executor for failure to timely administer decedent’s estate.
    • 2016 – Wayne County Probate Court
      • Obtained removal of attorney for estate due to improper management of estate assets.
  • Appellate Law
    • 2020 — Seventh District Court of Appeals (Green Maple v. Forrester, et al.)
      • Pending
    • 2016 – Eleventh District Court of Appeals (Sed v. Mundy, et al.)
      • Filed Amicus Brief and participated in oral argument in appeal of eviction.
    • 2014 – Fifth District Court of Appeals (Helms, et al. v. Whitney, et al.)
      • Obtained reversal of trial court decision in oil and gas dispute. Appellate court found that, under Ohio law, trial court lacked jurisdiction to order well plugged.
    • 2014- Eleventh District Court of Appeals (Mundy v. Mundy, et al.)
      • Summary judgment in favor of client upheld by appellate court.
  • Divorce and Family Law
    • 2018 – Carroll County Common Pleas Court
      • Obtained dismissal of civil protective order filed against client (husband).
    • 2018 – Wayne County Domestic Relations Court
      • In uncontested divorce action, client (wife) awarded custody of all five children and entirety of her pension by Court in termination of seventeen (17) year marriage.
    • 2017 – Wayne County Domestic Relations Court
      • Client (wife) receives spousal support of $700 per month in termination of sixteen (16) year marriage.
    • 2016 – Stark County Family Court
      • After three day trial, client (wife) awarded spousal support for forty-eighty (48) months.
    • 2015 – Stark County Family Court
      • Represented wife/mother in delinquent child support matter. After contempt hearing, husband/father sentenced to 30 days in jail for failure to pay child support.
  • Criminal Law
    • 2019 – Canton Municipal Court
      • Client charged with disorderly conduct. Charge dismissed by prosecutor.
    • 2017 – Wayne County Municipal Court
      • Client charged with aggravated trespass, assault, and petty theft. All three charges dismissed by prosecutor in exchange for plea to less charge of disorderly conduct.  Client sentenced to probation with no jail time.
  • Juvenile Law
    • 2018 – Wayne County Juvenile Court
      • Court awarded custody of one-year old child to our client (father) and ordered mother to pay child support to father.
    • 2018 – Wayne County Juvenile Court
      • Custody of minor child awarded to client (maternal grandmother) after paternal aunt and uncle had been legal custodians for over six years.
    • 2016 – Holmes County Juvenile Court
      • After two day hearing, client (father) awarded increased time with minor child and awarded child support from mother.
